Terms of Service

1. Acceptance of Terms

By accessing and using Favorites Gallery (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. License to Use

Favorites Gallery grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not: (a) modify, translate, or create derivative works based on the Service; (b) reverse engineer, disassemble, or decompile the Service; (c) remove any proprietary notices; or (d) use the Service for any illegal or unauthorized purpose.

3. Subscription & Billing

3.1 Subscription Tiers:

  • Free: 1 month of history, 50 files per sync, local backup only, ad-supported
  • Premium (Monthly): €2.99/month, recurring auto-renewal
  • Premium (Annual): €14.99/year, recurring auto-renewal
  • Premium (Lifetime): €49.99 one-time, permanent access

3.2 Free Trial:

New users receive a 30-day free trial of Premium features. At the end of the trial, your account will automatically convert to the selected subscription plan, or revert to Free if no payment method is on file.

3.3 Auto-Renewal & Cancellation:

  • Subscriptions auto-renew unless cancelled before the renewal date
  • You can cancel anytime through the app's Settings or your app store account
  • Cancellation takes effect at the end of your current billing period
  • No refunds are issued for partial months or cancellations mid-cycle

3.4 Refund Policy:

  • App Store (iOS): Governed by Apple's refund policy (typically 14 days)
  • Google Play (Android): Governed by Google's refund policy (typically 15 minutes for apps)

4. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes and in a way that does not infringe upon the rights of others
  • Maintain the confidentiality of your account credentials
  • Not upload, share, or backup any illegal, copyrighted, or third-party proprietary content
  • Not attempt to gain unauthorized access to the Service or its systems
  • Not reverse engineer, hack, or manipulate the app or backend services
  • Own or have permission to use all photos you backup through the Service

5. Cloud Storage & Backups

  • You retain all rights to your photos and backups
  • Cloud backups are sent to your selected storage provider (Google Drive, OneDrive, Dropbox, iCloud, SmugMug)
  • We are not responsible for data loss on cloud providers' servers
  • Cloud storage fees charged by providers are your responsibility
  • You can manually delete backups from the app or directly from the cloud service

6. Intellectual Property

The Service and all content within (including but not limited to design, features, algorithms, and UI) are the exclusive property of Favorites Gallery. You may not reproduce, distribute, or transmit any content without permission. Your use of the Service grants no ownership or intellectual property rights to you.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAVORITES GALLERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

9. Service Modifications & Termination

  • We reserve the right to modify or discontinue the Service at any time
  • We will provide notice of significant changes where practical
  • We may terminate your account if you violate these Terms
  • Upon termination, your access to the Service is immediately revoked

10. Indemnification

You agree to indemnify and hold harmless Favorites Gallery and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union / Netherlands, and you irrevocably submit to the jurisdiction of the courts in that location.
